中新社惠州1月12日电 (康孝娟 李有军) 12日下午，广东惠州市中级人民法院召开新闻发布会，通报2009年6月发生在惠州市的889路公交专线连撞28辆车、致4死10伤案件，肇事司机李国清经司法鉴定，精神障碍依据不足，维持死刑判决，于当天上午被押赴刑场执行死刑。

据通报，惠州市中级人民法院受广东省高级人民法院委托，当天上午召开宣判大会，以危险方法危害公共安全罪判处被告人李国清死刑，剥夺政治权利终身，并送达最高人民法院刑事裁定书。宣判后，罪犯李国清被押赴刑场执行死刑。

据惠州中院一审审理查明：被告人李国清原系惠州市诚通运输有限公司889路公交专线司机。2009年6月23日下午4时30分许，李国清因不满公司安排其在休假时加班，气愤之下，其无视公司发车规定，独自将刚下完客的粤L36217车驶离火车站广场，沿889路运营路线急速行驶，先后造成28辆机动车受损，4人当场死亡，1人重伤，9人轻微伤，受损车辆价值共计人民币561607元人民币。

案件审理期间，广东省精神卫生研究所对李国清的精神状况进行检查后作出司法鉴定，认定李国清曾有头颅外伤史和言行反常等表现，案发当时诊断精神障碍的依据不足。因此，法院认为，李国清无视国家法律，因不满公司安排加班和交班司机晚点交班，竟不顾不特定多数人的人身和公私财物安全，驾驶公交车在多个路段一路疾驶，连续制造多起碰撞车辆和人员伤亡的严重后果，其行为已构成以危险方法危害公共安全罪。其行为严重影响社会治安秩序和广大群众人身、财产安全，造成极其恶劣的社会影响，社会危害性和人身危险性极大，罪行极其严重。遂依法判处被告人李国清死刑，剥夺政治权利终身。

一审宣判后，被告人李国清不服，以量刑过重等为由上诉至广东省高级人民法院。广东省高级人民法院经开庭审理后驳回上诉，维持原判，并依法报请最高人民法院核准死刑。最高人民法院作出刑事裁定，维持一审以危险方法危害公共安全罪判处被告人李国清死刑，剥夺政治权利终身的刑事裁定。
